These terms are here to make sure our collaboration is smooth and enjoyable. They cover all of Kate Colmer's photography services, whether it's your first session or one in the future. Our goal is to ensure that everyone involved knows what to expect and enjoys the experience.

When you book a photoshoot, we want to make the process as smooth as possible. To secure your appointment, the total amount must be paid within two weeks of receiving the invoice. Once we've confirmed your booking, whether through a chat, a note, or an email, you're all set! Our journey together officially begins under these General Terms and Conditions. If you ever want to tweak anything, let's have a friendly chat and make sure we both agree on the changes.

• Currency: All prices are listed in Canadian dollars, unless otherwise specified.
• Included Material Costs: Our standard packages cover material expenses, ensuring you receive a comprehensive service.
• Special Requests: If you have specific requests like location rentals, travel, or additional items such as prints, canvases, photo books, or extra images, these are not included in the standard packages and will be billed separately.
• Payment Process: We kindly request payment in advance through Interac e-transfer. Your payment should be completed within two weeks of receiving the invoice.
• Service Commencement: Once your full payment is received, our services will begin promptly.
• Repeat Orders and Additional Services: Please note that any repeat orders or additional services will be billed separately.

• Partial Payment: If, at any point, the client fails to meet agreed-upon partial payments, Kate Colmer reserves the right to cancel or pause services.
• Default on Payment: In the event of payment default, services cannot be continued or used until all outstanding payments are settled.
• Late Payment Interest: If a payment exceeds the due date, a late payment interest fee of 5% may be charged.

We value your business and appreciate your cooperation in adhering to these terms. If you have any questions or concerns, please don't hesitate to reach out.

We understand that plans can change, and we aim to be flexible:

• If you need to cancel more than four weeks (28 days) before your appointment, you'll receive a full refund of the total amount.
• Cancellations made within one day (24 hours) to 27 days before the appointment will incur a modest cancellation fee of 30% of the total amount.
• In case of last-minute cancellations (less than 24 hours before the appointment), the full amount remains due. However, if you're unable to attend due to illness and can provide a valid medical certificate, you'll receive a full refund of the total amount minus a 30% cancellation fee.

To initiate a cancellation, please send us a written notice to Kate Colmer at kate@katecolmer.com. The time of receipt and the reason for your cancellation notice will be considered when processing your request.

Upon cancellation, we're committed to promptly refunding your payments. You can expect the refund to be processed within 14 days from the date of your cancellation. Please note that claims for additional costs, such as travel, meals, or accommodation, are excluded.

In the event of payment delays due to incorrect, incomplete, or updated payment details, the photographer will not be considered in default. Any additional costs resulting from such delays will be the responsibility of the client.

As a photographer, we understand that unforeseen circumstances may arise. We reserve the right to postpone your appointment. However, we are committed to rescheduling a new appointment that suits your needs. If we must completely cancel the appointment, you will receive a full refund of the total amount.

In situations beyond our control, such as natural disasters or other extraordinary events, your obligation to pay is voided if you are unable to attend your appointment. We'll work with you to find a suitable alternative in such cases.

Unless we've talked about a specific style in advance, your photos will be created in my unique style. I bring in creative elements like aperture choices (for that soft touch), lighting, and my distinctive approach to colour. I'm confident you'll adore the results, but it's essential to understand that requests for changes to these aspects will result in extra charges.

It's important to make sure you're on board with my style before booking your session. If, during our journey together, you'd like to adjust specific details, we can make that happen. Keep in mind that these modifications might have a fee of $30 per hour, but we’ll provide a quote for such edits before proceeding. It's all about making your photos uniquely you!

The photographer will make a reasonable effort to accommodate edit requests within a timely manner, but the turnaround time for edits may vary depending on the complexity of the request.

All photographic images created by Kate Colmer are protected by copyright laws. This includes all digital and printed photographs, whether commissioned or taken for personal use. The following copyright notice and terms apply:

1. Ownership: Kate Colmer retains full ownership and copyright of all photographs. Clients are granted a limited license for personal use only, which includes printing, sharing, and displaying the images.
2. Commercial Use: Any commercial use of the images is strictly prohibited without the explicit written consent of Kate Colmer. This includes, but is not limited to, advertising, promotional materials, and resale.
3. Attribution: Whenever sharing images on social media or online platforms, clients are encouraged to credit Kate Colmer as the photographer.
4. Distribution: Clients may share images with friends and family, but they are not authorized to sell or distribute the images for profit without written permission.

Violation of these terms may result in legal action for copyright infringement. Kate Colmer reserves the right to use the images for promotional purposes and may feature them on our website, social media, or marketing materials.
